1. Who we are and what this document is
These Terms are an agreement between you and AIRSTREAM SRL (IDNO 1018600007654, registered address: MD-2008, mun. Chișinău, str. Vasile Lupu 34/1, ap. 59, Republic of Moldova; “we”). They apply to the Bilipito app for parents (Android, iPhone and iPad), the web dashboard my.bilipito.com, the Bilipito Kids app (Android and iPhone) and the website bilipito.com, together “Bilipito” or “the service”. Versions for iPhone and iPad will come to the App Store later. These Terms already cover them: the provisions about iPhone, iPad and the App Store apply if you use Bilipito on an iPhone or iPad.
These Terms also include:
- the Payment and Subscription Terms;
- the Privacy Policy, on how we handle data.
You accept the Terms when you tick the box at your first sign-in. If you do not agree, do not use the service.
2. Who may use Bilipito
- Only a person of legal age may create an account.
- You may pair a child’s phone only if you are the child’s parent or other legal guardian, or act with their permission. You confirm this with a separate tick box.
- The child uses Bilipito Kids but is not a party to these Terms and does not create an account.
- Bilipito is not meant for monitoring adults, including a spouse, a partner, an employee or a grown-up child. When the child turns 18, monitoring must stop.
3. What Bilipito is
With Bilipito a family sees where the child is, gets notifications of arrivals and departures and the SOS signal, and sees the status of the child’s phone and screen time. In Bilipito you can set limits, write in the family chat, encourage the child with achievements and rewards and, when needed, listen to what is happening around the child or look through the camera live.
Bilipito is a helper, not an emergency service. How accurate and timely the data is depends on the child’s phone, the network, the battery, permissions and the limits of Android (and, if you use Bilipito on an iPhone or iPad, of iOS and iPadOS). Data may arrive late or be missing for a while. In a dangerous situation, call the emergency services (112).
Most features work only with an active subscription or during the free trial. Without one, the SOS button does not work either (see the Payment and Subscription Terms).
4. Account
- Give accurate details. Do not share your password, codes or PIN with anyone.
- You are responsible for activity in your account. If you think someone has gained access to it, change your password and write to [email protected].
- You can delete your account at any time in the app or in the web dashboard (bilipito.com/delete-account). Deleting the account does not cancel a Google Play or App Store subscription: it must be cancelled in the store where it was bought.
5. Family and roles
- The family owner creates the family, pays for the subscription, adds children, invites and removes adults and sets their permissions.
- An invited adult (a second parent, a grandmother, a grandfather, a nanny…) gets access by the owner’s invitation, and only within the permissions the owner has given (history, zones, sound and camera).
- The owner is responsible for making sure that every invited person has a lawful basis to see the child’s data, and for revoking access in good time (for example, when a nanny no longer works for the family).
- The owner can withdraw an invitation or remove an adult at any time. An invited adult can leave on their own. The family’s data stays with the owner.
- A family can have up to 4 adults (including the owner) and up to 8 children.
6. Rules of use
You must not:
- pair the phone of a person whose legal guardian you are not, or secretly follow anyone;
- stalk, intimidate, control or otherwise harm a person using Bilipito;
- pretend to be someone else when signing up or inviting;
- try to bypass the protection of, hack, overload or take apart (decompile) the service, except where the law expressly allows it;
- use the service for unlawful purposes or in breach of the rights of third parties;
- send unlawful or offensive content to the family chat, or someone else’s content you have no right to;
- create accounts again, use other people’s or temporary email addresses, or otherwise get around the restrictions in order to get the free trial again.
Tell the child, in words suited to their age, what the family can see. Bilipito Kids explains this too.
7. Sound and camera
Live listening and the camera exist for one thing: to make sure the child is all right, for example when the child is not answering. A session lasts no longer than 10 minutes; if needed, a new one can be started. When you use these features, you undertake:
- not to listen to or film other adults and strangers (teachers, other children, guests) for longer than is unavoidable to check on the child’s safety, and not to watch them with these features;
- not to record, intercept or publish the sound or image of a session by other means (screen recording, another phone and so on). Bilipito itself records nothing;
- not to use these features where people reasonably expect particular privacy: in changing rooms, toilets, medical rooms, at other people’s private meetings;
- to comply with the laws of your country on the privacy of private life and of conversations.
While a session is running, the child sees a notice and the system microphone or camera indicator. If you breach this section, we may suspend or end access (section 11).
8. Licence and intellectual property
- We grant you a limited, non-exclusive, non-transferable and revocable licence to use Bilipito for personal family purposes for as long as these Terms apply.
- All rights in the apps, the website, the interface, design, texts, icons, character avatars, achievement badges, games, map styling and the “Bilipito” brand belong to AIRSTREAM SRL or its licensors. The map uses OpenStreetMap data © OpenStreetMap contributors (ODbL licence).
- You may not copy, sell, rent out or modify the service, except where the law expressly allows it.
9. Your content
Your content is the child’s avatar photo, messages and photos in the family chat, zone names, reward texts and role labels.
- The rights to it stay with you.
- You allow us to store and process this content and show it to the members of your family, only to run the service and for the periods set out in the Privacy Policy.
- By uploading a photo of the child or of another person, you confirm that you have the right to do so: as the legal guardian or with that person’s consent.
- We do not use your content in advertising and do not publish it.
- We may remove content that clearly breaks the law or these Terms.
10. Compatibility and updates
- Bilipito works on phones with Android 10 or newer and in modern browsers, and the iPhone and iPad versions work on the iOS and iPadOS versions shown on the app’s App Store page. For Bilipito Kids to work fully, it needs permissions (location, including in the background, physical activity, microphone, camera, usage access, accessibility) and an exemption from power saving. On an iPhone, Bilipito Kids needs location “Always”, “Motion & Fitness”, notifications, microphone, camera and Screen Time. Without them, some features do not work.
- Some phone makers limit apps running in the background. Because of this, data may be less accurate or arrive late.
- We release updates: we fix errors, strengthen security and add features. Old versions may stop being supported over time; the app will then ask you to update.
- We may change or discontinue individual features. If the paid service gets significantly worse as a result, we will tell you in advance, and you will be able to cancel the subscription (see the Payment and Subscription Terms).
11. Suspension and termination
You can stop using Bilipito at any time: to do so, delete your account. The subscription must be cancelled separately in Google Play or the App Store, wherever it was bought.
We may suspend or end access if:
- you seriously or repeatedly breach these Terms, especially sections 2, 6 and 7;
- there are reasonable signs that a phone was paired without the right to do so;
- the law or a decision of an authorised body requires it;
- it is needed to prevent harm to the child, to other people or to the service.
Unless the matter is urgent, we will tell you the reason in advance and give you a chance to explain or fix the breach. You can appeal the decision by writing to [email protected]; we will reply within 30 days.
If a free trial was obtained by getting around the rules (section 6), we may end it early. This does not affect a paid subscription.
If we end access through no fault of yours, we will refund the unused part of the paid period in proportion to the time remaining, through support ([email protected]) and Google Play, and for an App Store subscription through support and Apple (App Store refunds are issued by Apple). After termination, data is processed and deleted in line with the Privacy Policy. Before it is deleted, you can ask for a copy.
We may shut down the whole service with at least 60 days’ notice. The same refund rule for the unused paid period then applies.
12. Changes to the Terms
- We will tell you about significant changes in advance, at least 30 days before, in the app or by email. The app will ask you to accept the new version.
- If you do not agree, you can delete your account and cancel the subscription before the changes take effect.
- Minor changes (typos, clarifications that do not change your rights) take effect when published.
- The current version, with its number and date, is always available at bilipito.com/terms.
13. Liability
- We do everything reasonable for Bilipito to work reliably. But we cannot guarantee that it works without interruptions and errors: this also depends on phones, networks, Google, Apple and other providers.
- We are not liable for damage if it is caused by your breach of these Terms, wrong settings, missing permissions or network on the child’s phone, an inactive subscription, actions of third parties or force majeure.
- We are not liable for indirect losses or lost profits, unless the law provides otherwise.
- Nothing in these Terms limits our liability for intent or gross negligence, for harm to life and health, or your consumer rights that cannot be limited by law.
14. Complaints and disputes
- You can send a complaint to [email protected] or by post to: AIRSTREAM SRL, MD-2004, mun. Chișinău, str. Sfatul Țării 59, et. 2, Republic of Moldova. Give the email of your account and what the matter is about. We will reply within 30 days.
- We first try to settle disputes through negotiation.
- These Terms are governed by the law of the Republic of Moldova. Disputes are heard by the courts of the municipality of Chișinău.
- If you are a consumer living in another country, you keep the mandatory rights and protection given by the law of your country of residence, including the right to go to court where you live, if that law provides for it.
15. Other provisions
- Severability. If any provision is found invalid, the rest remain in force.
- No waiver. If we did not use a right straight away, it does not mean we have given it up.
- Assignment. We may transfer our rights and obligations under these Terms to another company (for example, in a reorganisation). Your rights are kept, and we will tell you in advance. You may not transfer your account without our consent.
- Force majeure. We are not liable for failures for reasons beyond our reasonable control: failures of networks and providers, natural disasters, actions of authorities.
- Entire agreement. These Terms, together with the Payment and Subscription Terms and the Privacy Policy, are the whole agreement between you and us about Bilipito.
- Language. The Terms are published in several languages. If the language versions differ, the Romanian version prevails.
- App stores. Google Play and Apple are not parties to these Terms and are not responsible for Bilipito. The rules of the store where the purchase is made (Google Play or the App Store) also apply to purchases. For apps from the App Store, the terms below also apply.
Additional terms for apps from the App Store
If you downloaded Bilipito or Bilipito Kids from the App Store, the following also applies:
- These Terms are concluded between you and AIRSTREAM SRL, not with Apple Inc. (“Apple”). AIRSTREAM SRL, not Apple, is responsible for the app and its content.
- The licence in section 8 allows you to use the app only on Apple-branded devices that you own or control, as permitted by the App Store Usage Rules. The app may also be used by other accounts associated with you through Apple Family Sharing, to the extent those Rules allow.
- Apple has no obligation to provide any maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the extent the law allows, Apple has no other warranty obligation with respect to the app. Any other claims, losses and costs caused by a failure to conform to a warranty are the responsibility of AIRSTREAM SRL.
- AIRSTREAM SRL, not Apple, handles claims by you or third parties relating to the app or its use. This includes product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If a third party claims that the app or its use infringes its intellectual property rights, AIRSTREAM SRL, not Apple, will be responsible for the investigation, defence, settlement and discharge of that claim.
- You confirm that you are not located in a country that is subject to a US Government embargo or that the US Government has designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
- Send questions, complaints and claims about the app to us; the contacts are in section 16.
- When using the app, comply with applicable third-party terms, for example those of your mobile operator.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. When you accept the Terms, Apple has the right to enforce them against you as a third-party beneficiary.
